Making a Power of Attorney means that you (the Donor) are giving someone else (your Attorney) the legal power to look after some or all of your legal affairs.
Usually clients wish to give their Attorney power to look after their financial affairs on their behalf, from paying the bills to selling property – depending on what is set out in the Power of Attorney document.
A General Power of Attorney is the simplest way of making a Power of Attorney.
In certain circumstances, a Lasting Power of Attorney - LPA - is more appropriate as here, the Attorney can continue to look after the Donor even if the Donor has lost what is known as mental capacity – the ability to make their own decisions. It is now possible to make a Lasting Power of Attorney which deals with personal property or one which deals with personal welfare, or both.
